The SEC has posted a version of its Enforcement Manual dated October 6, 2008, to its website. The 122-page Enforcement Manual is filled with important guidance, practices and procedures for the Enforcement staff, and should be read just as carefully by private attorneys who practice in the enforcement area. It contains detailed information on key processes such as opening investigations, obtaining formal orders, responding to requests for copies of the formal order, the Wells process, terminating investigations, conducting telephone interviews, and so on.
I’m not aware that the SEC has ever made such a manual publicly available before. Just to be safe I’m downloading my copy now before it disappears from the website!
