Assistant Attorney General Lanny Breuer, head of the Justice Department’s Criminal Division, stated today that the DOJ is planning to focus more criminal enforcement under the FCPA related to the pharmaceutical industry’s interaction with foreign officials. The Blog of the Legal Times reports that Breuer said the application of the FCPA to the pharmaceutical industry will be pushed “in the months and years ahead.”
According to Breuer, the DOJ
will be intensely focused on rooting out foreign bribery in your industry. That will mean investigation and, if warranted, prosecution of corporations, to be sure, but also it will involve investigation and prosecution of senior executives.
