Confidential witnesses are endangered species in NY securities cases

Back in 2009, when Barrack, Rodos & Bacine was amassing evidence for a Manhattan federal court shareholder class action against AIG, the firm could assure confidential witnesses that their identity was likely to be protected, even if AIG wanted to find out who was talking to plaintiffs’ lawyers….

That was then. Now, on the other hand, there’s a clear trend in Manhattan federal court to force plaintiffs’ lawyers to cough up the identity of confidential witnesses….
