SEC Tactics Cause Counsel to Change Strategy – Risk & Compliance – WSJ

Companies facing the SEC now have to change their strategy for dealing with the agency, legal experts said. Matthew Rossi, a partner with Mayer Brown LLP who served in the SEC’s enforcement division until March, said the move toward administrative judges makes the Wells process even more important to companies, and their defense counsel, than it typically is. It becomes one of the only ways for companies to tell the SEC not to bring a claim against them, he said….
